Update: Victim's and suspect's names released in deadly Mingo County shooting

MINGO COUNTY, W.Va. (WSAZ) - Updated Wednesday
The Mingo County Sheriff released the name of a man who was shot and killed along Hell Creek Road near Delbarton Tuesday, as well as the name of the suspect in the case.

According to Sheriff James Smith, James Gannon was shot and killed.

Sheriff Smith says Donald Marcum will be charged Wednesday with second-degree murder.

Gannon is accused of stealing items from Marcum's home. Marcum then followed Gannon's car in an effort to get his property back.

Marcum and Gannon eventually stopped and got out of their cars. Sheriff Smith says Marcum had already pulled out his gun when Gannon drew his gun as well.

Marcum then reportedly shot and killed Gannon.

According to Sheriff Smith, Gannon was driving a stolen vehicle.

The Mingo County Sheriff's Department is investigating a shooting in Delbarton Tuesday evening.

According to Sheriff James Smith, one man is dead and the shooter is in custody.

Deputies are still on the scene taking statements, and West Virginia State Police are assisting in the investigation.
