Class -action lawsuit filed on behalf of miners in Blackjewel bankruptcy case
Attorneys representing the Blackjewel miners filed a class-action lawsuit on their behalf on Thursday.
The suit was filed in the Southern District of West Virginia bankruptcy court in Charleston.
Plaintiffs named in the case include miners from Blackjewel operations in Kentucky, Virginia and West Virginia.
The complaint states that all of the affected workers were laid off without the required Worker Adjustment and Retraining Notification or WARN notice.
It also asks for damages, interest, costs and fees in an undetermined amount.
No word on when the case may go to court.
Blackjewel Mining and all of its subsidiaries filed for Chapter 11 bankruptcy earlier this month, leaving hundreds of miners in several states without pay and without jobs.
